Terms & Conditions – D KONDE DESHMUKH REALTORS (Pune)

1. General

  • D KONDE DESHMUKH REALTORS (hereinafter referred to as “the Company”) acts as a real estate consultant/facilitator for property transactions including new property sales, resale property, land/plot transactions, rental agreements, and home loan assistance.

  • All services are provided in good faith, with the intention of ensuring transparent, professional, and smooth transactions.


2. Property Information & Verification

  • Property details (area, price, location, legal status, amenities, etc.) shared by the Company are based on information received from developers, owners, or third parties.

  • While we make every effort to verify documents, final due diligence remains the responsibility of the buyer/seller/investor/tenant.

  • The Company shall not be held liable for any misrepresentation, dispute, or legal issue arising after the transaction.


3. Booking & Payment

  • All payments related to property purchase, resale, or rental must be made directly to the developer, builder, or property owner as applicable.

  • The Company does not accept or hold client funds for property transactions unless specifically agreed in writing.

  • Booking amounts and payment schedules are governed by the builder’s/owner’s terms, and the Company is not liable for changes in price, availability, or payment policies.


4. Service Charges / Brokerage

  • For New Property (Builder Projects): Brokerage/consultancy charges may be included in the builder-developer agreement (where applicable).

  • For Resale, Rental, and Plot Transactions: Standard service charges/brokerage (as per market practice in Pune and Maharashtra) will be applicable and communicated before finalizing the deal.

  • Brokerage is considered earned and payable once the buyer/seller/tenant/landlord agrees to the deal, regardless of cancellation by either party.


5. Home Loan Assistance

  • The Company only provides guidance and referral support for home loan approvals.

  • Loan sanction, disbursal, and terms are strictly between the client and the financial institution.

  • The Company is not responsible for loan rejection, delay, or changes in interest rates/conditions.


6. Documentation & Legal Compliance

  • The Company assists clients with basic documentation, however, legal verification (Title Search, 7/12 Extract, NA Order, Encumbrance, etc.) must be carried out by the client’s legal advisor/advocate.

  • Stamp duty, registration charges, GST, TDS, or any government levies/taxes are payable by the client as per prevailing laws.


7. Rental Transactions

  • The Company facilitates rental agreements between landlord and tenant.

  • Drafting, e-registration, police verification, and other statutory compliances are the responsibility of the concerned parties.

  • Brokerage is typically one month’s rent from both landlord and tenant (or as mutually agreed).


8. Cancellation & Refunds

  • Once a property booking is confirmed, cancellation/refund policies will be governed by the concerned builder, developer, or owner.

  • The Company shall not be responsible for refund delays or disputes between parties.


9. Limitation of Liability

  • The Company’s role is advisory and facilitative in nature.

  • We are not responsible for:

    • Delays in possession by builders.

    • Quality or construction defects.

    • Title disputes, legal litigations, or government approvals.

    • Market risks, price fluctuations, or investment losses.


10. Confidentiality & Privacy

  • Client information shared with the Company is kept confidential and used only for property-related services.

  • The Company does not misuse or sell client data to unauthorized third parties.


11. Jurisdiction

  • All disputes, if any, shall be subject to Pune, Maharashtra jurisdiction only.
